This Home & Public Charging Promotional Offer (Promotion”) is available to persons resident in Canada, as part of your commitment to purchase or lease a new Model Year 2022 or 2023 VinFast vehicle from VinFast Auto Canada Inc. (“VinFast Canada”). The Promotion is subject to the definitions, qualifications, limitations, and requirements set forth in these “Terms and Conditions”.
Under Terms and Conditions of the Offer, you may qualify to receive our “Recharged Up” offering.

DEFINITIONS: Throughout these Terms and Conditions, you acknowledge that your purchase or lease contract will specifically identify your vehicle as eligible for this offer on the purchase order documentation. Throughout this document, references to “We”, “Us”, and “Our” shall refer to and mean VinFast Canada, a company legally incorporated and operating under the laws of British Columbia having its registered office located at 2025 Willingdon Avenue, Suite 900 Burnaby, B.C., V5C 0J3 Canada.
In addition, certain words and phrases are defined as follows: Promotion Term: The offer is available to anyone who reserves a VinFast Canada vehicle from May 31st 2022 (retroactive) through September 30, 2022 and will be redeemable upon taking delivery of the car before December 31, 2023, unless otherwise extended by VinFast Canada, in its sole and absolute discretion. Delivery Date means the date your Eligible Vehicle is reported as delivered by your approved VinFast Canada authorized facility. Pre-Delivery Installation means installation of the VinFast Home Charger at a qualified primary single-family residence that meets the installation requirements stated in these Terms and Conditions, prior to the Delivery Date and after receipt of the Home Charger. Credit Amount means the lesser of: (i) the amount actually paid by Customer for the Home Charger Installation and applicable permit costs; and (ii) $1000 CAD. Eligible Vehicle means a new Model Year 2022 or 2023 VinFast vehicle, that a Customer has purchased or leased, or committed to purchase or lease from a VinFast Canada retailer located in Canada. Committed to Purchase or Lease means a Customer has provided authorization for a VinFast Canada authorized facility (?)to place an order for the purchase or lease of an Eligible Vehicle or a Customer has placed a deposit with VinFast Canada for an Eligible Vehicle. Qmerit Home Charging Assessment (QHCA) refers to the assessment the Customer is required to submit to initiate a match with a Qmerit Certified Installer. Installation means the set up and electrical wiring of a Vinfast Home Charger at your single-family residence that meets the installation requirements stated in these Terms and Conditions. Installer refers to a Qmerit certified contractor provided through the installation services of Qmerit Electrification Canada Ltd. (“Qmerit”). Qmerit means, the organization that is responsible for selecting, qualifying, and certifying Installers to complete home installations for Vinfast Customers who are eligible for the Promotion.
CHARGED UP BY VINFAST CANADA HOME CHARGING OUTLET INSTALLATION PROMOTION PROCESS –
How it works: each eligible Customer who has purchased or leased or Committed to Purchase or Lease an Eligible Vehicle will have the option of participating in this Promotion. If you choose to participate , you will qualify for a free VinFast Canada Home Charger (Wall Unit), plus up to $1,000 CAD Credit towards Home Charging Installation, plus 3 Years of Public Charging Coverage paid for by VinFast Canada. All information you provide, and your qualification is subject to verification by a Qmerit certified Installer. If you are eligible for this Promotion, VinFast Canada will submit your first and last name, phone number, postal code, email address and VIN to Qmerit. If you elect to have home Installation, your choice must be made within thirty (30) days of delivery date, otherwise your choice must be made within ten (10) days of your Vehicle Delivery Date, and this Agreement is deemed entered on such date.
Within 45 days of your anticipated delivery date, VinFast Canada will send you an email invitation to complete the QHCA by providing all requested information including description of your garage, electrical panel specifications and location, desired charger location, confirmed receipt of HOA, landlord, and any other necessary third-party approvals, and submited photos of your garage layout, electrical panel, and charging location. Uploading inappropriate, obscene, or offensive photos is strictly prohibited; VinFast Canada has the sole and exclusive discretion to disqualify any Customer from this Promotion in the event such photos are uploaded. You, the Customer, are responsible for obtaining all necessary HOA, landlord, and other third-party approvals prior to submitting the QHCA. The personal information you provide in connection with this Promotion (including on the QHCA) will be handled and received by VinFast Canada and Qmerit for the purposes of administering your participation in the Promotion and providing related products and services to you and as otherwise set out in their respective privacy policies or permitted by applicable law. By submitting your personal information, including any uploaded photos, you consent to the collection, use, disclosure and retention of your personal information by each of VinFast Canada and Qmerit in accordance with their respective privacy policies, which can be found here: Privacy Policy | VinFast Auto Canada Privacy Policy | Qmerit. The QHCA will assist in determining if your residence meets the Installation requirements for the single-family Home Charger Installation.
For Customers who submit the QHCA, Qmerit will find and match a local, qualified, insured, and licensed Installer to complete the installation. Once Qmerit has recommended your Installer, Qmerit will provide their business name address, phone number, and email address to you and will provide the Installer with your name, address, phone number, and email address. Your Installer may reach out via email or phone to review the details submitted in QHCA and confirm that they can perform the necessary work. Each Installer will endeavor to secure all necessary permitting, in accordance with local applicable law, on your behalf. Once all required permits are secured, the Installer will schedule your Installation. Once Installation is complete, the Installer will submit confirmation to Qmerit. Installation must be completed within 180 days of your Eligible Vehicle Delivery Date and will take place on the date agreed between you and the Installer.
Installation Scope of Work: For each eligible Customer Installation, the Installer will complete the following:
- Install a hardwired 48-amp VinFast Home Charger (provided separately by VinFast)
- Provide and install new 60-amp breaker in panel, or appropriately derate the charger to fit within available panel capacity
- Provide and install code-compliant electrical wiring, protective tubing, and weatherproofing as required
- Use #6-gauge wire
- Create, submit, and apply for local permit (fees to be paid by Customer)
- Perform main panel load calculation
Installation Requirements: To qualify to receive a single-family home Installation, the following requirements must be met:
- Installation is limited to single family homes, duplex, condo, or townhome - provided Customer has a dedicated meter and electrical panel
- Final location of hardwired charger must be attached to the same structure as that on which the main electrical panel is located (interior or exterior)
- Customer is required to obtain HOA, landlord and any other required third-party approval prior to submission of QHCA and Installation
- Installation work may only be done if the applicable permits have been obtained and the work may be done to appropriate code standards
- Without limiting the foregoing, Installer must be able to obtain all required permits prior to commencement of proposed installation
- The existing electrical service must have enough ampacity for the new charging load
- The electrical panel must have 60 amps of spare ampacity according to the load calculation for the new breaker or the installer must derate the charger or offer additional electrical services to support the charging load
- Work site must be made safe and accessible to Installer
- Wiring runs must be externally mounted and visible to Installer
- There must be clear access for Installation
- There can be no asbestos or lead paint in the home and at risk of disturbance
- Drywall, stucco, plaster, concrete, or any other repairs to walls, ceilings, or floors if penetration is required for wiring runs are not included and must be contracted separately
- Installer must be part of the Qmerit certified network, and chosen by Qmerit to complete Installation
VinFast Canada will provide up to a $1,000.00 CAD credit to be applied towards an Installation (including permit) completed by a Qmerit certified Installer. The Installer shall complete the Installation and the Customer will be responsible to pay Qmerit directly for all costs including permits that exceed $1000.00 CAD, as may be agreed between Customer and Installer. This credit can be used towards Installation of a VinFast Canada Charing Station (which will also be given complimentary as part of this charging offer).
Lastly, VinFast Canada will also be including three (3) years of public charging coverage.
COSTS in General: Any unforeseen additional repairs and/or costs arising from inspections and/or Installation not directly related to Installation or those amounts that exceed the Installation Credit Offer
will be the sole responsibility of the Customer, who is solely responsible to pay all such amounts directly to Qmerit. Wiring runs within walls (finished or unfinished) will incur extra costs and are not included in this Promotion. Installation does not cover obsolete breakers (including but not limited to Zinsco, Federal Pacific & Bulldog Pushmatic.) If garage structure is not attached to residence, any required trenching will incur extra costs and are not included in this Promotion. All costs associated with installation that are not included in this Promotion are the sole responsibility of the Customer. Any upgrade costs beyond the Installation will be agreed upon between the Customer and Installer and will be the sole responsibility of the Customer. Any additional costs will be provided in a written estimate by Installer to Customer prior to work beginning.. Any costs associated with the use or misuse of the Home Charger (for example, electricity charges) are the sole responsibility of the Customer. In addition to the foregoing costs, 1) all costs associated with a successful Installation that meets the Installation Requirements, including but not limited to all costs associated with obtaining the appropriate permitting, will be paid for by VinFast Canada up to a maximum of $1,000 CAD; 2) the Customer is solely responsible for all costs associated with Installation (including permit) that exceed $1000.00 CAD; both to be paid directly to Qmerit.
AGREEMENT TO THESE OFFICIAL RULES: By completing and submitting the QHCA, each Customer fully and unconditionally agrees to and accepts these Terms and Conditions as the official rules of the Promotion and further agrees the decisions of VinFast Canada regarding this Promotion are final and binding in all matters related to the Promotion. These Terms and Conditions, constitute an agreement (this “Agreement”) between VinFast Canada and the Customer, and is the entire agreement between the parties concerning its subject matter, supersedes all prior agreements and understandings, whether or not written, and is not intended to confer upon any person other than the parties, including any creditors, any rights, or remedies hereunder.
GENERAL CONDITIONS / RELEASE: Each Customer, by participating in this Promotion, agrees (a) to release, indemnify and hold harmless VinFast Canada, Qmerit, the Installer and their respective affiliates, parents, subsidiaries, advertising and promotion agencies and their respective past and present directors, officers, employees, representatives and agents from and for any liability for any injuries, losses or damages of any kind, to persons or property (including without limitation death; claims based on publicity rights, defamation or invasion of privacy; and any claims based on a violation of a third party’s intellectual property rights), resulting in whole or in part, directly or indirectly, from your participation in this Promotion, Installation, or in any related activity or your acceptance, possession, use, misuse or non-use of a VinFast Home Charger. Without limiting the foregoing, you agree that VinFast Canada is not responsible in any way for Installer actions, recommendations, or any resulting damage caused by or attributable to your Installer. VinFast Canada’s failure to enforce any of these Terms and Conditions shall not constitute a waiver of that provision. VinFast Canada may cancel, terminate, or suspend this Promotion in its sole discretion. You agree to the use of electronic signatures and documents. By placing your deposit, you agree that your name and signature shall be affixed to this Agreement and constitute your electronic signatures to the same extent as if you had used your written signature.
Governing Law: This section applies to the fullest extent permitted by applicable law and does not apply to individual’s resident in the Province of Quebec. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, Customer’s rights and obligations, or the rights and obligations of VinFast Canada in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the province of British Columbia, without giving effect to any choice of law or conflict of law rules (whether of the province of British Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the province of British Columbia, where this contract is deemed to be entered.
Misrepresentations and Fraud: Your participation in the Promotion may be cancelled by VinFast Canada, in its sole discretion, if you conceal or misrepresent any material fact or circumstance, including, but not limited to, your personal information, Eligible Vehicle, or any information provided on the QHCA, or otherwise.
Non-Transferable: An eligible Customer may not assign or transfer its rights under the Promotion at any time. The rights under the Promotion are non-transferable to any subsequent purchaser or lessee, or any other person or entity to whom the Eligible Vehicle is conveyed by operation of law or otherwise, including without limitation repossession, death, or as a gift.
Tax Implications: You may be subject to federal, provincial/territorial, or local tax on any benefits received under this Promotion. You should contact a Tax advisor/consultant if you have any questions regarding the tax implications associated with this Promotion.
PUBLIC CHARGING: VinFast Canada is proud to be partnered with ChargeHub who will provide you with access to over 6,400 Level 2 Charging Stations and over 840 Level 3 (DCFC) Fast Chargers across Canada. ChargeHub offers Public Charging services across the U.S., as well, which is not part of this Promotion. For your ease of reference, a list of the currently enabled Charge Point Operators can be found at 
ChargeHub Passport Presentation | ChargeHub. Both ChargeHub and VinFast Canada are currently working on agreements to further expand charging network partnerships. This will provide VinFast Canada Customers with one of the most comprehensive charging networks across Canada.
VinFast Canada reserves the right to terminate any charging account that is found to be abusing the free charging promotion. This promotion is intended to support the charging experience of a single (one of your vehicles and is not intended for commercial use.
Drivers who do not unplug and move their vehicle ten minutes after their charging session is complete will be charged a $0.40 CAD per minute idle fee. This fee encourages drivers to move their vehicle promptly so that others can use the charger. You can be notified when your charging session is complete via the VinFast Canada Companion App (on your mobile device) or see it from within your VinFast Canada vehicle on the main screen. Receipts for additional tariffs will be available through your VinFast Companion App where it can be filtered by date.
Setting up an account is easy and only takes a few minutes while setting up your Customer App. You can set up your charging account from the comfort of your home or with the assistance of our VinFast staff. A valid credit card is needed to start an account and is in place to cover any additional idle fees or tariffs associated with your charging session. VinFast Canada does reserve the right to adjust the price of penalties for staying at a charging station once a vehicle has been fully charged and reserves the right to adjust the time at which a tariff would be charged to drivers relative to the state of charge on the vehicle.
To access the range of features and services available for charging on the VinFast Canada Charging network, you will be able to log in to your VinFast Canada Customer App. Once you set up you account, you will be able to view the approved VinFast Canada charging stations near you, check their availability, easily start or check in on the status of your charging session and more from your smartphone or computer. Designed to Combine Charging System (CCS) standards your VinFast Canada Public Charging experience is designed for the simplest and easiest Charging Experience.
ADVANCED DRIVERS ASSISTANCE SYSTEM / SMART SERVICES
The VinFast Canada ReCharge promotion provides one (1) year of subscription services which will allow Customers to add additional functionality such as the Automatic Lane Change, Summoning feature, Automated Parking and Remote Parking. With Automatic Lane Change enabled, VinFast Canada vehicles can indicate when a lane change is optimal and initiate the maneuver while following signaling protocols. Your commute will never be the same with the suite of in-car connected features and a virtual assistant to accompany you wherever you go. VinFast’ Canada’s Virtual Assistant connects you and your vehicle to bring you a seamless and personalized driving experience. From in-car gaming, audio and video streaming services to Smart home controls. Virtually everything’s in sync with the effortless integration of your smartphone.
