VINFRIENDS REFERRAL REWARDS PROGRAM TERMS AND CONDITIONS

 

The VinFriends Referral Rewards Program (“Program”) is a program offered by VinFast Auto Canada Inc. (“VinFast”), whereby current VinFast customers are eligible to receive a prepaid card (“Prepaid Card”) when they refer someone they know to VinFast and that person buys or leases a new VinFast vehicle from a VinFast showroom (such person a “Referred Customer”). If a Referrer (as defined below) wishes to participate in the Program, they agree to be bound by these terms and conditions (“Terms”).

 

  1. ELIGIBILITY

For a person to be eligible for a PrePaid Card (such person being the “Referrer”), they must either be the registered owner of a new VinFast vehicle (ie. first owner) or a VinFast Certified Pre-Owned vehicle. Current owners that: (i) purchased or leased a used VinFast vehicle, including any demonstration vehicles, (ii) are employees or affiliates of VinFast, or (iii) purchased their vehicle through VinFast’s Employee Purchase Program, are not eligible to be Referrers. 

 

  1. HOW TO REFER A NEW CUSTOMER

A Referrer must obtain a unique referral code by calling or visiting a VinFast showroom. Once received, a Referrer may share their referral code with a prospective Referred Customer. Please note there is a limit of 10 referral code redemptions, and referral codes are only to be used for personal and non-commercial purposes. If you provide the personal information of your Referred Customer, you represent and warrant that you have the legal right to share this information with VinFast. 

 

  1. LIMITATIONS AND EXCLUSIONS

In addition to any other limitation and exclusion in these Terms, VinFast WILL NOT provide a Prepaid Card in any of the following events:

  1. A Referred Customer: 

    1. Fails to use the Referrers referral code when buying or leasing a new VinFast vehicle;

    2. Is unable to take delivery of the VinFast vehicle by December 31, 2025; or 

    3. Is taking delivery of the VinFast vehicle in British Columbia.

  2. A Referrer:

    1. Makes the referral code available to the general public (such as posting on a social media platform, business card or website, or spamming unsolicited emails/phone calls);

    2. Uses, displays or manipulates VinFast intellectual property without VinFast’s explicit consent;

    3. Is from British Columbia and the Referred Customer is taking delivery of their vehicle in British Columbia; 

    4. Acts in violation of these Terms or in a manner that bring VinFast into public disrepute, contempt, or scandal;

    5. Is reasonably suspected of fraud or abuse of these Terms by VinFast; or

    6. Engages in paid advertising, selling or paying or offering incentives for use of the referral code.

  3. PREPAID CARD DETAILS

A Prepaid Card will be in the amount of $250.00 if a Referred Customer purchases or leases a new VF8, or $350.00 in the event the Referred Customer purchases or leases a new VF9. A Referrer is not entitled to receive a Prepaid Card until they:

  1. Are confirmed eligible and contacted by VinFast to collect the Prepaid Card;

  2. Complete and sign a standard Program claim form that, among other things, (i) confirms Referrers compliance with these Terms; (ii) acknowledges acceptance of the Prepaid Card as awarded; and (iii) [THIS SUBSECTION 4(b)(iii) DOES NOT APPLY TO QUÉBEC CONSUMERS] releases VinFast any and all liability in connection with provision of the Prepaid Card and Referrers use of the Prepaid Card; and

  3. Come to physically pick up the Prepaid Card at the VinFast showroom where the Referred Customer took delivery of their new VinFast vehicle. VinFast will not mail Prepaid Cards, provide electronic versions or provide any substitutions. 

VinFast may take up to 30 days after the delivery of the new vehicle to Referred Customer to contact Referrer. A Referrer can earn a maximum of 10 Prepaid Cards in connection with this Program. 

 

  1. DISCLAIMER

Referrer is solely responsible for any costs, taxes, local requirements, fees or other expenses incurred in connection with their use of the Prepaid Card. Any issues with use of the Prepaid Card are not the responsibility of VinFast, and Referrer agrees to address any issues with the Prepaid Card financial institution. 

VinFast does not make any representation or offers any warranty, express or implied (except for Québec consumers, who may benefit from warranties implied under sections 37, 38, 53 or 54 of the Québec Consumer Protection Act, c. P-40.1, to the extent those sections apply), as to the quality or fitness of the Prepaid Card. Referrer acknowledges that the Prepaid card provided in connection with the Program is provided “as is”. 

 

  1. GENERAL TERMS AND CONDITIONS

Discontinuation and Changes. VinFast reserves the right to amend, suspend or terminate the Program in its sole discretion at any time. 

Invalidity. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

Governing Law. [THIS PARAGRAPH DOES NOT APPLY TO QUÉBEC CONSUMERS] To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms or the rights and obligations of Referrer or VinFast will be governed by and construed in accordance with the provincial laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. To the fullest extent permitted by applicable law, the parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Terms or relating to the Program.

Intellectual Property. All intellectual property, including but not limited to referral codes, trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations, is owned by VinFast or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

 

Language. [For Québec consumers only] Entrant acknowledges having received the French version of these Terms and has requested and agrees to be bound by the English version instead.
